Welcome to Mountain Magic Resort! These Terms of Service (“Terms”) govern your use of our website at www.mountainmagicresort.com and the vacation rental services we offer. By accessing or using our website, you agree to be bound by these Terms.

1. Use of Our Website

You agree to use our website only for lawful purposes and in accordance with these Terms. You may not use our site to:

• Violate any laws or regulations

• Make false or fraudulent reservations

• Disrupt or damage the website or its content

2. Booking and Payment

To book a vacation rental, you must provide accurate personal information and payment details. Payments are securely processed through PaySafe.com. A reservation is not confirmed until payment is received and you receive a confirmation email.

3. Cancellations and Refunds

Our cancellation and refund policy will be outlined during the booking process and may vary by property or season. Subject to change.

• We charge a $50 cancellation fee for every reservation canceled, period. Any refund due to a guest cancellation is minus our cancellation fee. 
• Full refund for cancellations 60 days out. 75% refund, if canceled within 28 days of arrival. 50% with 14 days notice. No refunds for cancellations within 14 days of arrival, "unless your dates are re-booked." We will happily refund 100% of everyone's cancelled rents "if your dates re-book." 
• Please note: We re-book canceled dates often, but there is no promise and you can always purchase third party trip insurance! Last-minute cancellations can be difficult to rebook as we cannot just hang a vacancy sign by the side of the road. Thank you for understanding.

4. Guest Responsibilities

Guests must:

• Follow all check-in/check-out times and property rules

• Treat the property with care and respect

• Refrain from illegal activities on the premises

• Be financially responsible for any damages caused during the stay

5. Prohibited Conduct

You may not use our services to:

• Harm, harass, or defraud other guests or property owners

• Circumvent or misuse our payment processing systems

• Upload or transmit malicious code

6. Limitation of Liability

Lake Wateree Vacations is not liable for any direct, indirect, incidental, or consequential damages arising from your stay or use of our website, except where prohibited by law. All properties are rented "as is," and we do our best to provide accurate listings and descriptions.

7. Intellectual Property

All content on this site—including text, photos, logos, and design—is the property of Mountain Magic Resort and may not be copied, reproduced, or used without permission.

8. Changes to These Terms

We reserve the right to modify these Terms at any time. Updates will be posted on this page with the effective date. Continued use of the website or services indicates acceptance of the revised Terms.

9. Governing Law

These Terms are governed by the laws of the State of North Carolina, without regard to conflict of law principles. Any disputes shall be handled in the courts of Watauga County, North Carolina..
